01Who we are
vivers is published by Sanbitt 2020, S.L. (“Sanbitt”, “we”, “us”), a company registered in Spain. Registered office: Calle Mallorca 272, planta 4, puerta 3, 08037 Barcelona, Spain. Tax ID (NIF): B01984251. You can reach us any time at hello@vivers.app.
The app is distributed as “vivers” on the Apple App Store and as “com.sanbitt.vivers” on Google Play.
02Who can use vivers
You must be at least 16 years old to use vivers on your own. If you are younger, you may only use it with the consent and supervision of a parent or guardian, who accepts these terms on your behalf.
Some features need an account. Keep the details you give us accurate, keep your sign-in credentials to yourself, and let us know at hello@vivers.app if you think someone else is using your account. You are responsible for what happens under it.
03What vivers is — and what it is not
vivers gives you self-guided tours and audio guides: routes, audio narration, text, images and maps that you follow at your own pace, on your own device. Some content is triggered by your location, and tours can be downloaded to be used offline.
vivers is not a guided tour with a live guide, not a ticket seller, not a navigation service and not an emergency service. Routes, walking times, distances and directions are indications, not exact instructions.
04Free tours and paid tours
Some tours are free and others are paid. The price and what it includes are shown in the app before you buy.
- Paid tours are bought through the Apple App Store or Google Play. That store processes the payment and handles your payment method, and its own terms apply to the transaction alongside these terms.
- A purchase gives one person access to that tour from the store account used to buy it, for as long as the tour is in our catalogue and the app is supported. Unless we say otherwise, it is a one-off purchase, not a subscription.
- We may change prices at any time. A change never affects a tour you have already bought.
- Free tours may be modified, made paid or removed at any time.
05Refunds and right of withdrawal
Because purchases are made through the app stores, refunds are handled by Apple or Google under their own policies — ask them first. If the problem is with our content (a tour that will not play, or content that is missing or wrong), write to hello@vivers.app and we will try to fix it or help you get your money back.
Tours are digital content delivered immediately. When you buy one and start downloading or playing it straight away, you are asking for immediate performance and you accept that you lose the 14-day right of withdrawal that EU and Spanish consumer law would otherwise give you. Your statutory rights if the content is faulty are not affected.
06How you may use the content
We give you a personal, non-exclusive, non-transferable and revocable licence to use the app and the tours you have access to, for your own private, non-commercial enjoyment — including with the people physically walking with you.
You may not:
- copy, record, screen-capture, publish, sell, rent, sublicense or otherwise share the audio, text, images or routes, outside the app’s own offline download feature;
- use our tours commercially — for paid or organised group tours, or as a script for tours you run yourself;
- scrape, bulk-download, reverse engineer or try to extract the content or the software behind it;
- remove or hide any copyright or ownership notice.
All content in vivers — audio, texts, photographs, maps, routes, software, the vivers name and logo — belongs to Sanbitt or to our licensors and is protected by copyright and other rights.
07Your safety while you walk
Tours take place in real streets and public spaces. You are responsible for your own safety at all times.
- Pay attention to your surroundings, to traffic and to other people. Do not look at your phone while walking or crossing the street — stop somewhere safe first.
- Follow traffic rules, local laws, signs, and the instructions of authorities or venue staff.
- Judge your own physical condition and health before starting a tour, and check the weather, the terrain and opening hours.
- Look after your belongings, and use common sense in quiet areas or after dark. Children must stay under the supervision of the adult they are with.
- GPS, maps and location triggers can be inaccurate or unavailable — between tall buildings, indoors or with poor coverage — and streets change. Trust your eyes over the app.
- In an emergency, call 112 or your local emergency number.
You follow tours at your own risk.
08Places, venues and third parties
Information about monuments, museums, shops, restaurants, opening hours, prices and access is given in good faith and may be out of date or change without notice. We do not run those places and we do not sell entry tickets — buy them from the venue itself.
Some routes pass through places with their own rules, fees or opening times; please respect them. Third-party services the app relies on or links to (maps, app stores, payment providers) have their own terms.
09Availability of the app
We work to keep vivers available and working, but we cannot promise it will be uninterrupted or error-free. We may add, change, suspend or discontinue tours, features or the app itself, and we may release updates for security or compatibility.
Some features need an internet connection, location permission or storage space, and offline use requires downloading a tour in advance. Your device, its operating system and your data costs are your responsibility.
10Reviews, feedback and acceptable use
If you send us ratings, reviews, photos, suggestions or other feedback, keep it lawful, honest and respectful, and make sure it does not infringe anyone else’s rights. You keep what you own, and you give us a free, worldwide, non-exclusive licence to use it to run and improve vivers, including showing it in the app. We may remove anything that breaks these terms.
Do not use vivers for anything illegal, to harass or harm others, to disrupt or break into our systems, to share your account access, or to fake your location or bypass payment.
11Ending the agreement
You can stop using vivers at any time by deleting the app. To delete your account and the data attached to it, use vivers.app/delete-account or write to hello@vivers.app. Deleting your account ends your access to it, including tours linked to it; whether a purchase can be restored afterwards depends on the app store’s own rules.
We may suspend or close an account that breaks these terms or the law, or where we are legally required to do so.
12Liability
Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, for fraud, or your rights as a consumer.
Beyond that, vivers is provided as it is. We are not liable for indirect or unforeseeable losses, for lost data, for what happens around you while you follow a tour or for the decisions you take on the way, for third-party venues and services, or for inaccurate location data. Where we are liable, our liability is limited to what you paid us for the tour concerned in the twelve months before the problem arose.
13Your personal data
We process personal data to give you an account, remember your progress and purchases, and answer your messages. You can ask us to delete your account and data at vivers.app/delete-account.
A separate privacy notice explaining this in detail, and how to exercise your rights under the GDPR, is being published — until then, write to hello@vivers.app with any question about your data.
14Changes to these terms
We may update these terms — for example when the app changes or the law does. The date at the top always shows the current version, and we will flag any significant change in the app or by email. Continuing to use vivers after a change means you accept the new terms. Changes never apply retroactively to a purchase you have already made.
15Governing law and disputes
These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings before the courts of your place of residence. Otherwise, the courts of Barcelona, Spain, have jurisdiction.
If something goes wrong, please write to us first at hello@vivers.app — most things are quicker to solve that way.
